Anmol Bishnoi Extradited To India: Anmol Bishnoi, brother of gangster Lawrence Bishnoi, has been taken into police custody in California, USA. Intelligence sources said that earlier this month a non-bailable warrant was issued against Anmol.
The incident comes weeks after the Mumbai Police Crime Branch initiated the extradition process of Anmol Bishnoi, who is wanted in the NCP leader Baba Siddiqui murder case and the shooting at actor Salman Khan’s Bandra residence. Anmol also has two cases registered against him by the National Investigation Agency (NIA) and 18 other criminal cases.
NIA has placed a reward of Rs 10 lakh on Anmol
Recently, NIA has announced a reward of Rs 10 lakh to the person who provides information leading to the arrest of Anmol Bishnoi. In the first week of this month, Mumbai Police had sent a formal proposal for Anmol’s extradition. This proposal was sent when American officials informed Mumbai Police about Anmol Bishnoi’s presence in their country.
The police officer said that Mumbai Police has sent the proposal for extradition of Anmol Bishnoi to the Ministry of Home Affairs (MHA), which will later be sent to the Ministry of External Affairs (MEA). There is suspicion of involvement of Bishnoi brothers, residents of Fazilka, Punjab, in this case. Lawrence Bishnoi is currently lodged in Sabarmati jail, Gujarat.
How will Anmol Bishnoi come to India?
To bring any accused from another country to India, it is necessary to have an extradition treaty between the two countries. Even if this does not happen, extradition arrangement also works. In India, a law regarding this was made in 1962. According to the Ministry of External Affairs, India has extradition treaties with 48 countries and extradition arrangements with 12 countries. An agreement is made in the treaty that if a wanted criminal is found in another country, he is later sent back.
India had signed an extradition treaty with America in 1997. Between 2002 and 2019, 10 criminals have been brought to India from America. Different countries have different laws regarding extradition, but there are some things common regarding it in international law.
What does international law say?
Under international law, people accused of political crimes, military crimes and religious crimes cannot be extradited. Not only this, it is also necessary for both the countries to believe in the crime of the accused for whom extradition has been sought. Apart from this, even after the crime for which extradition is sought, he must face the same trial and no other trial can be instituted. Human rights are also taken into account.
