Will Hemant Soren’s chair of the post of CM go away if he loses the membership of the assembly? Know what are the rules

CM Hemant Soren: Jharkhand Chief Minister Hemant Soren’s chair and his legislature are in danger, he may have to resign from the post of Chief Minister at any time. Actually, for the last several months, there is an atmosphere of turmoil in Jharkhand. After the IAS Pooja Singhal episode, the CM was being slapped. At the same time, the ED recovered 2 AK-47 rifles and 60 cartridges from the bases of Jharkhand’s famous power broker Prem Prakash in Ranchi, after which the opposition is now openly demanding the resignation of CM Hemant Soren.

allegation of abuse of office
Chief Minister Hemant Soren is accused of misusing his position and got the mining lease allotted in his own name during his tenure. In the matter of benefits of the post, Soren seems to be getting stuck in such a way that it is very difficult for him to get out. In this matter, the Election Commission of India has submitted its advice to Governor Ramesh Singh Bains regarding his assembly membership. The governor can take a decision on his disqualification at any time. The news is that the Election Commission has recommended the cancellation of Hemant Soren’s membership. The final decision on the recommendation of the Election Commission is to be taken by the Governor.

…then the assembly membership will end
It is being told that Hemant Soren’s assembly membership will end as soon as the order of Governor Ramesh Singh Bains is issued on the instructions of the Election Commission. In such a situation, he will have to resign. Because the coalition headed by Hemant Soren has a majority in the assembly, so after his resignation, he can stake claim to form the government afresh. In this situation Hemant Soren can become the Chief Minister again. Governor Ramesh Bains is presently present in Ranchi. Meanwhile, Hemant Soren’s party Jhakhand Mukti Morcha (JMM) has directed all its MLAs to stay in the capital Ranchi.

It will be difficult to remain CM in this situation.
However, it is not yet clear whether Hemant Soren has been disqualified to contest the elections or not. It will be clear only after the decision of the Governor. Soren will find it difficult to continue as chief minister if the Election Commission has recommended the governor to disqualify him.

BJP and Hemant Soren put forth their stand
It is noteworthy that in the name of Chief Minister Hemant Soren, a stone quarry lease was allotted in Anagada, Ranchi. He surrendered it later, but on the complaint of BJP regarding this matter, the Central Election Commission has heard several rounds of hearings. Both BJP and Chief Minister Hemant Soren, the complainant of this case, had put forth their respective sides. At the same time, on August 18, the Election Commission had reserved the decision after completing the hearing. At the same time, the Election Commission has submitted its decision to the Governor in a closed envelope.

Basant Soren can be subscribed
Hemant Soren won from 2 assembly constituencies Dumka and Barhait assembly constituency in the 2019 elections and was elected MLA. But later he resigned from Dumka assembly constituency and decided to remain MLA from Barhait. This was followed by a by-election to the Dumka assembly seat vacated by his resignation, in which his brother Basant Soren won as a JMM candidate. Basant Soren is also accused of taking mines lease while being an MLA and hearing in this matter is also going on in the Election Commission. The next date of hearing in this case has been fixed by the commission on August 28. Because the case of Basant Soren is also similar to that of CM Hemant Soren, so his membership is also believed to be known.
