Some judges are lazy, some incompetent; Collegium usually does not act: Retired Judge Jasti


Former SC Justice Jasti Chelameswa: Former Supreme Court Justice Justice Chelameswar surprised the collegium with his statement on Tuesday (April 11). The former Justice said that the collegium, which appoints and removes judges in the High Court and the Supreme Court, works in a very ambiguous manner. He said that he often does not take any action when there is an opportunity to level allegations against the judge.

Not only this, he said about some judge that he is lazy and clearly incompetent. He said these things in the opening speech at the National Seminar on “Is Collegium Alien to the Constitution” organized by Bharatheeya Abhibhashaka Parishad at Kerala High Court.

‘Judges do not write judgments on time’

Former Justice Chelameswar also said, “Many judges are lazy and do not write judgments on time while many others are downright incompetent.” He further added, “Some allegations may come before the collegium, but usually nothing is done.” Is. If the allegations are serious then action should be taken. The only common solution is to transfer the judge… Some judges are just lazy and take years to write a judgement. Some judges are incompetent.”

He said that after retirement, he can also become a victim of online trolling and criticism by speaking on this subject.

The retired judge said, “Now if I say anything, tomorrow I will be trolled saying ‘why is he saying all this after retirement’, but this is my fate. But recently the Supreme Court Sent back two decisions of the High Court because it did not understand what was said in the decisions.

‘An independent judiciary is essential for the survival of democracy’

However, he also said that an independent judiciary is very important for the existence of any democracy. Failing that, he said, “Just imagine what would happen otherwise. Imagine what a policeman can do. It is not that they are bad, but they have power and can be a law unto themselves.”

Retired Judge Chelameswar neither appreciated nor welcomed the recent statement of Law Minister Kiren Rijiju. He also pointed out, “Our law minister has made a statement based on the 42nd amendment. And I must say that this kind of masculinity is bad for everyone. Not focusing on what needs to be improved. Make wiser and wiser decisions in the best interest of your children and offspring.”
