Actually, the Constitution Bench does not sit on Mondays and Fridays. Generally, the proceedings of such benches are held on Tuesdays, Wednesdays and Thursdays only. Considering the speedy hearing of the same-sex marriage case as necessary, the Chief Justice has said that even in the Ayodhya case, a bench of 5 judges used to sit for the whole week.

When this hearing started on April 18, the central government had said that some learned people sitting in the courtroom cannot take decisions for the whole society. Parliament is the right place to discuss the issue of gay marriage. But on that day also the Chief Justice had said that apart from postponing the hearing, the government should make any other demand. The next day i.e. on April 19, the government issued notices to all the states and demanded to hear their side as well. But the court did not give any order on this also.

‘Judges are being trolled in social media’
The Chief Justice, who is presiding over the bench of 5 judges, also discussed the criticism of the judges in the social media. He said that he is being ‘trolled’ on social media over the judges’ comments on same-sex marriage. But it does not matter. In fact, the most criticized is the same remark of Chief Justice Chandrachud in which he said that there is no concept of being completely male or female. Only the gender of the body does not decide it. This is a more complex subject than this.

‘Quickly end the debate’
The Chief Justice talked about continuous hearing next week when the petitioner’s lawyers were not able to finish their arguments. He said that the petitioners were given 3 days. Here only the question of making arrangements for same-sex marriage by making changes in the Special Marriage Act is being considered. There is no need for such a long argument in this. He said that it would be better if the petitioners complete their arguments today. Then the government and the organizations opposing this demand can complete their talk by next Thursday. However, due to the non-completion of the arguments of the petitioner side, he will get a chance on Monday as well. Therefore, it cannot be said that the hearing will end next week.

Comment on the mental development of children
The Chief Justice, sitting with Justices Sanjay Kishan Kaul, S Ravindra Bhat, PS Narasimha and Hima Kohli, also commented on the plea of ​​the National Commission for Protection of Child Rights (NCPCR). NCPCR has opposed child adoption to same-sex couples in view of the mental and emotional development of children. The Chief Justice said that if a father beats his wife after getting drunk, doesn’t it affect the children?

‘The matter is not limited to big cities only’
Earlier, the court had also rejected the government’s argument that same-sex marriage is only an idea of ​​some urban elite. The Chief Justice had said that the government has not given any such figure, so that this point can be proved.
