Veer Savarkar Defamation Case: Recently, while hearing the case registered against Rahul Gandhi for his alleged inflammatory and controversial statement on Veer Savarkar, the Lucknow court has issued summons to Rahul Gandhi. The court has ordered Rahul Gandhi to appear on January 10, 2025.
The court of Additional Chief Judicial Magistrate III, Lucknow has summoned Congress leader Rahul Gandhi for prima facie offenses under sections 153(A) and 505 of the Indian Penal Code. Lawyer Nripendra Pandey, while filing the complaint, had alleged that Rahul Gandhi, during a press conference in Akola, Maharashtra on December 17, 2022, had called Veer Savarkar a “servant of the British” and a “pensioner”.
‘Statement given with the intention of spreading hatred’
Nripendra Pandey had said that this statement was given with the intention of spreading disharmony and hatred in the society. Along with this, pre-prepared leaflets were also distributed among the journalists in the press conference, which shows a planned action by the opposition.
What was Rahul Gandhi’s statement?
During the Bharat Jodo Yatra in Maharashtra in November 2022, Rahul Gandhi had claimed in a statement about Veer Savarkar that Savarkar had helped the British. Savarkar had written a letter to the British saying that he wanted to remain their slave. Due to fear, Savarkar signed the apology and betrayed Mahatma Gandhi and other leaders.
Before this, orders for investigation were given
Lucknow’s Additional Chief Judicial Magistrate Ambrish Kumar Srivastava had ordered investigation on the same petition filed by lawyer Nripendra Pandey under section 156 (3) of CrPC. The court directed Hazratganj police station to investigate the case by an inspector level officer.
