Naresh Balyan Latest News: A Delhi court has denied relief to Naresh Balyan, Aam Aadmi Party (AAP) MLA from Uttam Nagar seat, in a case related to alleged organized crime. The court sent the AAP MLA to judicial custody till January 9, 2025. Whereas Delhi Police refused to give the AAP MLA on remand.
Delhi court said that AAP MLA Naresh Balyan cannot be ‘forced’ to cooperate in the investigation.
The basis for taking remand is wrong
Special Judge Kaveri Baweja rejected the application filed by Delhi Police, which had sought additional remand of Balyan for 10 days in the case registered under the Maharashtra Control of Organized Crime Act (MCOCA). Judge Baweja said that the grounds given by the investigating agency do not justify extending the custody.
The judge said that the police, while seeking extension of Balyan’s custody period, argued that he did not cooperate during the custody period and did not answer questions during interrogation. The court said that one of the grounds stated by the investigating officer (IO) seeking extension of police custody is that the accused is not disclosing the names of other members of organized crime.
The judge said, “There is no doubt that the accused cannot be compelled to cooperate in the investigation or to give any information that can be used against them.”
He said that the police custody cannot be extended to confront the accused with other members who are definitely still absconding.
The court said, “There is no certainty as to when and how he will be arrested, therefore, it cannot be a ground for extending the police custody of the accused to confront him (Balyan) with those who are absconding.”
Delhi Police’s lawyer told this to the court
Special Public Prosecutor Akhand Pratap Singh, who represented Delhi Police in the court, requested for Balyan’s custody and said that there is a need to interrogate him to unearth a bigger conspiracy in this case. Let us tell you that the MLA was arrested on December 4 in an alleged organized crime case, whereas before this a court had granted him bail in an alleged extortion case.
