UP Municipal Election 2022: A hearing was also held on Saturday in the Lucknow bench of the Allahabad High Court regarding the UP civic elections. After hearing the arguments of both the sides, the court has reserved the decision. The verdict will be pronounced on 27 December. In the case of implementation of OBC reservation in civic body elections, the petitioner’s side and the government side’s lawyer gave arguments. The petitioner’s lawyer, LP Mishra, first presented his side in the hearing regarding reservation in civic body elections. The lawyer said that the reservation for OBCs has been prepared on the basis of political reports. A dedication commission should be formed which will decide on reservation. The existing reservation system is not doing justice to the backward classes.
The counsel for the petitioner read out the order of the Supreme Court in detail in the Suresh Mahajan vs. Government of Madhya Pradesh-2021 case in front of the judge. The judge started further hearing after reading the order of the Supreme Court. The government lawyer, keeping his side, said that his rapid survey is similar to the triple test done by the dedicated commission. On behalf of the petitioner, the government lawyer said that women’s reservation was called horizontal reservation. The hearing could not be completed on Friday due to paucity of time. During the hearing on Wednesday in the division bench of Justice Devendra Kumar Upadhyay and Justice Saurabh Lavania, it was argued on behalf of the petitioners that OBC reservation in civic elections is a kind of political reservation.
Compulsory triple test by dedicated committee
Under the arrangement given by the Supreme Court, before the OBC reservation is decided, it is mandatory to conduct a triple test by the dedicated committee. At the same time, the state government has said in the affidavit that the OBC survey conducted in 2017 should be considered as the basis of reservation in the case of local body elections.
