Bangladesh is making a big move to extradite Sheikh Hasina, now it has brought International Criminal Law


Amidst the conflict with India, the Bangladesh government is making efforts from all sides for the extradition of former Prime Minister Sheikh Hasina. Not only is the Mohammad Yunus government preparing to present its demands to India by taking legal action, but it has also brought a legal expert who is demanding the extradition of Sheikh Hasina citing the legal rules of Bangladesh.

Speaking to The Hindu, Mohammad Yunus said that the government will soon officially talk to the Indian government for the extradition of the former prime minister. However, he has no objection to Sheikh Hasina’s Awami League party contesting the elections. On the other hand, law expert Toby Cadman has said that he feels that being a democratic country, India will follow the judicial process of Bangladesh and extradite Sheikh Hasina.

Toby Tadman is an internationally renowned criminal law expert and is also a Special Advisor to the Chief Prosecutor of the International Crimes Tribunal (ICT) in Bangladesh. After meeting ICT Chief Prosecutor Tajul Islam and other officials on Wednesday (December 11, 2024), he emphasized that it is the responsibility of India to maintain the rule of law as it is a democratic country. If Bangladesh requests them then they should respect it and send Sheikh Hasina back.

Cadman also told that if India does not extradite Sheikh Hasina, then what options do Bangladesh have? He said that if India rejects the request after framing of charges, then Bangladesh can take the help of international laws to take action in the absence of Sheikh Hasina and for this it can also take help from the International Criminal Court (ICC).

After the coup in Bangladesh on August 5, Sheikh Hasina resigned from the post of Prime Minister and came to India. Hundreds of cases are registered against him in Bangladesh including murder, attempt to murder, genocide, kidnapping, crimes against humanity and attack on the procession of Bangladesh Nationalist Party. She has been living in India since August.
