Bihar Teacher News: After a decision of the High Court, the jobs of two hundred teachers of Gopalganj are in danger. The education department has started preparing the horoscope of such teachers. These are those teachers who, despite being untrained, were reinstated after March 31, 2015. While hearing the petition filed by such teachers, Patna High Court has declared the employment or appointment of untrained teachers reinstated after March 31, 2015 as invalid. After this decision of the High Court, there is a stir among the untrained teachers reinstated after 2015.
DPO Establishment Mohd. Jamaluddin issued a letter on April 15 and directed all the BEOs to provide the details of all the teachers appointed by the local bodies after March 31, 2015 to the office as soon as possible.
The Center had implemented the law in 2010 itself
The Central Government implemented the Right to Education Act on April 1, 2010. This law came into effect in Bihar on 31 March 2015. There were instructions in this that only trained teachers should be kept in service. After the appeal of the teachers, the court gave relief to the teachers and ordered to complete the training by 31 March 2019. After this, in the hearing of the case of Ataur Rahman and others vs Government regarding the same matter, the High Court has ordered to relieve the teachers who have not completed the training even after this period.
Despite the matter being taken to court, reinstatement was done
The matter of relieving untrained teachers was in the court since 2015. Meanwhile, thousands of untrained teachers were reinstated across the state. More than 200 untrained teachers were reinstated in Gopalganj also. On the other hand, after the decision of the High Court to relieve the teachers, these teachers appealed in the double bench. This bench gave its verdict on March 22 in which it declared the appointment of untrained teachers reinstated after 2015 as invalid. After this, details of such teachers have been sought from the department headquarters.
Further action will be taken on the orders of the department – DPO
Following the instructions of the High Court, details of untrained teachers appointed after March 31, 2015 are being prepared. All BEOs have been asked to provide information about teachers in one format. This detail will be given to the department headquarters. Further action will be taken in the light of the departmental order.
