Supreme Court on EWS: The Supreme Court on Tuesday (May 16) dismissed review petitions filed against the decision to uphold the quota for Economically Weaker Sections (EWS). Dismissing the petition, the court said that no error is evident in front of the record.
10% reservation for Economically Weaker Sections (EWS) was introduced in the 103rd Constitutional Amendment. A 5-judge bench of Chief Justice DY Chandrachud, Justice Dinesh Maheshwari, Justice S Ravindra Bhat, Justice Bela M Trivedi and JB Pardiwala dismissed the review petition.
Earlier also the quota was kept intact
Significantly, on November 7, 2022, a 5-judge bench upheld the EWS quota by a 3:2 majority with the dissent of the then CJI UU Lalit and Justice Ravindra Bhat. Since Justice Lalit has retired, the review bench was headed by the current CJI, Justice Chandrachud.
What was the opinion of the Justice who agreed in the bench?
The three Justices who agreed were of the opinion that the introduction of reservation on the basis of economic criteria is not a violation of the basic structure of the Constitution. It was also found that there was nothing discriminatory in excluding persons entitled to SC/ST/OBC reservation from the purview of economic reservation. Also, breach of 50% ceiling limit on behalf of EWS reservation does not violate the basic structure.
