89 percent population of the state already deserves reservation, why did Tamil Nadu government say this in Madras High Court?


Tamil Nadu Government: The Tamil Nadu government told the Madras High Court that 89 percent of the state’s population is already eligible for 69 percent reservation in education and government jobs. The government told the court that because of this the state cannot be forced to implement additional 10 percent reservation for others under the Economically Weaker Section (EWS) category.

Government’s response to PIL

This argument was given by the state government during the hearing on a PIL filed in the year 2020 by Amparia Nambi Narasimha Gopalan of Tirunelveli district. On behalf of the plaintiff, a demand was made to direct the state government to implement 10 percent EWS quota for admission in all higher educational institutions of the state.

According to The Hindu report, the Tamil Nadu government, in its reply, told the court, “Following the instructions issued by the Supreme Court on October 14, 1982, 100 percent door-to-door enumeration of castes and communities was carried out in the state in 1983.” Till now the same data was being used to provide reservation to backward classes, extremely backward classes and denotified communities.”

‘About 89 percent of the total population deserves reservation’

Data collected over two years by the Second Tamil Nadu Backward Classes Commission (known as the Ambashankar Commission), set up in 1983, revealed that the proportion of socially and educationally backward classes in the state was 68 per cent of the total. , which includes extremely backward classes and denotified communities.

The Tamil Nadu government said, “In the 2011 census, Scheduled Castes in Tamil Nadu were 20 per cent and Scheduled Tribes were 1.1 per cent. Due to this, about 89 per cent of the total population was covered under the existing provisions related to reservation in education and government jobs and Only 11 percent did not get its benefit.”

On behalf of the Tamil Nadu government, it was said in the court that Articles 15(6) and 16(6), included in the Constitution through the 103rd Amendment from January 14, 2019, only give the Center and the States the right to give 10 percent EWS reservation.

The state government also told the court that the 103rd constitutional amendment has been challenged and the matter is pending in a five-judge bench of the Supreme Court.
